Terms of Service

These Terms of Service ("Terms") govern your access to and use of paydownway.com and any related online services operated by Growefy Media OÜ ("Growefy," "we," "us," or "our") under the PayDownWay brand (the "Site" or "Service").

By accessing the Site, using the Service, or submitting information through the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Who We Are

PayDownWay is operated by Growefy Media OÜ, a private limited company registered in the Republic of Estonia.

Growefy Media OÜ is a marketing-consulting firm. We are not a lender, credit broker, debt-settlement company, debt-management plan provider, credit-counseling agency, law firm, financial advisor, tax advisor, or insurer. We do not make loans, broker loans, collect debts, make cash advances, make credit decisions, or provide legal, tax, financial, credit, settlement, or insurance advice.

The Site is a free, advertising-supported marketing and educational matching tool that helps U.S. consumers submit information that may be used to explore available options through our current marketing partner, AmOne / QuinStreet, Inc.

2. No Offer, Solicitation, or Guarantee

The Site does not constitute an offer, solicitation, approval, pre-approval, commitment, or guarantee for any loan, credit product, debt-relief program, debt-management plan, settlement program, financial product, or other service.

Submitting information through the Site does not guarantee that you will be approved, matched, contacted, offered any product or program, qualify for a loan, receive savings, reduce debt, enroll in a program, or achieve any specific result.

Not all consumers qualify. Availability varies by state, provider, program, offer, and individual circumstances.

3. Eligibility

The Site is intended only for U.S. residents who are at least 18 years old.

By using the Site, you represent that:

  • you are at least 18 years old;
  • you are a resident of the United States;
  • the information you provide is accurate, current, and complete;
  • you are using the Site for your own personal, non-commercial purposes; and
  • you have authority to provide the information you submit.

You may not use the Site if doing so would violate any law, regulation, agreement, or third-party right.

4. How the Service Works

PayDownWay allows you to submit information about your debt situation and related details. With your consent, Growefy Media OÜ may share the information you provide with AmOne / QuinStreet, Inc. and approved service providers for matching, eligibility, offer-display, contact, analytics, fraud prevention, compliance, and related business purposes.

After you submit information, you may be redirected to another website, shown additional information, contacted by phone, text, email, or other permitted methods, or receive no response if no option is available.

Any third-party product, service, offer, program, or communication is provided by the applicable third party, not by Growefy Media OÜ or PayDownWay.

5. Partner Relationship

For this campaign, our current marketing partner is AmOne / QuinStreet, Inc.

Growefy Media OÜ may share submitted information with AmOne / QuinStreet, Inc. for the purposes described in these Terms and our Privacy Policy. Once your information is transferred to AmOne / QuinStreet, Inc., it may also be governed by their own terms, privacy practices, and applicable legal obligations.

Growefy Media OÜ is not an agent, representative, employee, broker, or fiduciary of any lender, credit partner, debt-relief provider, financial-services provider, or consumer.

6. Compensation Disclosure

PayDownWay is free for consumers to use.

Growefy Media OÜ may receive compensation from AmOne / QuinStreet, Inc. when submitted information is accepted, matched, sold, transferred, clicked, converted, or otherwise qualifies under our commercial arrangement.

This compensation may influence how the Site is operated, including what forms, flows, pages, disclosures, or partner handoffs are used. However, PayDownWay does not make credit decisions, provide debt-relief services, rank offers for you, guarantee outcomes, or charge you for submitting information.

7. No Advice

All content on the Site is provided for general informational and marketing purposes only.

Nothing on the Site is legal, tax, financial, credit, settlement, insurance, or professional advice. You should not rely on the Site as a substitute for advice from a qualified advisor who understands your situation.

Before accepting any offer, enrolling in any program, stopping payments, consolidating debt, or making a financial decision, you should review all terms carefully and consult a qualified legal, tax, financial, or credit advisor as appropriate.

8. Debt-Relief and Credit Risks

Debt-relief, settlement, consolidation, or similar programs may not be right for everyone.

Depending on the option or program, potential risks may include:

  • negative impact on your credit score;
  • fees or costs;
  • collection activity;
  • lawsuits from creditors or collectors;
  • increased balances from interest, late fees, or penalties;
  • tax consequences from forgiven debt;
  • no guarantee that creditors will participate;
  • no guarantee of savings, settlement, approval, or enrollment.

PayDownWay does not evaluate whether any option is appropriate for you. Any decision to move forward with a third-party product, service, or program is your responsibility.

9. User Information and Accuracy

You agree to provide accurate, current, and complete information when using the Site.

You may not submit false, misleading, fraudulent, incomplete, or unauthorized information. You may not submit information for another person without permission.

We may reject, block, delete, or disregard submissions that we believe are fraudulent, inaccurate, abusive, automated, duplicative, non-compliant, or otherwise improper.

10. Consent to Electronic Communications

By using the Site, you consent to receive disclosures, notices, agreements, records, and other communications electronically.

You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law.

You are responsible for maintaining a valid email address and access to the devices and software needed to receive electronic communications.

11. TCPA and Marketing Consent

By submitting information through the Site, you authorize Growefy Media OÜ, AmOne / QuinStreet, Inc., and parties acting on their behalf to contact you at the telephone number(s) and email address you provide, including through automated dialing systems, prerecorded messages, artificial-voice messages, SMS/MMS messages, and email, for marketing, eligibility, matching, and related purposes.

You understand that consent is not a condition of purchase. Message and data rates may apply. You may opt out of SMS by replying STOP or following the instructions in the message. You may also contact us at support@paydownway.com.

You represent that any phone number you provide is your own number or a number you are authorized to provide.

12. Privacy

Your use of the Site is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, share, retain, and protect information, including information shared with AmOne / QuinStreet, Inc., service providers, advertising partners, and other parties described in the Privacy Policy.

By using the Site or submitting information, you acknowledge the practices described in the Privacy Policy.

13. Third-Party Websites and Services

The Site may link or redirect to third-party websites, forms, offers, services, or platforms.

We do not control third-party websites or services. We are not responsible for their content, terms, privacy policies, security, communications, products, services, decisions, fees, or practices.

Your interactions with any third party are solely between you and that third party.

14. No Endorsement

References to third-party names, trademarks, products, services, or websites, if any, are for identification or informational purposes only and do not imply endorsement, sponsorship, partnership, approval, or recommendation unless expressly stated and approved.

No lender, provider, partner, media outlet, review platform, or financial-services company endorsement is implied by the Site.

15. Intellectual Property

The Site, including its text, design, graphics, logos, layout, software, code, content, and other materials, is owned by Growefy Media OÜ or its licensors and is protected by applicable intellectual-property laws.

PayDownWay™ is a trademark of Growefy Media OÜ.

You may not copy, reproduce, modify, distribute, display, sell, license, scrape, frame, reverse engineer, or create derivative works from the Site or its content without our prior written permission.

All other trademarks, service marks, trade names, product names, and logos appearing on the Site are the property of their respective owners.

16. Acceptable Use

You agree not to:

  • use the Site for unlawful, fraudulent, misleading, or abusive purposes;
  • submit false, fake, incomplete, or unauthorized information;
  • impersonate another person;
  • interfere with the Site's operation or security;
  • attempt to access systems, data, or accounts without authorization;
  • use bots, scrapers, scripts, or automated tools without permission;
  • test, scan, or probe the vulnerability of the Site;
  • transmit malware, harmful code, or spam;
  • violate any applicable law, regulation, or third-party right;
  • use the Site to generate fraudulent leads, invalid traffic, or improper submissions.

We may suspend, block, restrict, or terminate access to the Site if we believe you have violated these Terms or applicable law.

17. Availability and Changes to the Site

We may modify, suspend, discontinue, or restrict the Site or any part of it at any time without notice.

We do not guarantee that the Site will be available, uninterrupted, secure, error-free, or compatible with every device, browser, or system.

We may update forms, content, disclosures, flows, partner handoffs, or eligibility questions at any time.

18. Disclaimer of Warranties

The Site and Service are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Growefy Media OÜ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.

We do not warrant that:

  • the Site will meet your needs;
  • the Site will be uninterrupted, secure, or error-free;
  • any information will be accurate, complete, or current;
  • you will be matched, approved, contacted, or offered any option;
  • you will save money, reduce debt, lower payments, or achieve any specific result;
  • any third-party product, service, provider, or program will be suitable for you.

19. Limitation of Liability

To the fullest extent permitted by law, Growefy Media OÜ and its owners, officers, directors, employees, contractors, affiliates, service providers, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from or related to your use of the Site, your inability to use the Site, any third-party website or service, any communications you receive, or any product, service, offer, or program you pursue.

To the fullest extent permitted by law, our total liability for any claim arising from or related to the Site or these Terms will not exceed one hundred U.S. dollars (US $100) or the amount you paid us to use the Site, whichever is greater. Because the Site is free to use, this amount will usually be US $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

20. Indemnification

You agree to indemnify, defend, and hold harmless Growefy Media OÜ and its owners, officers, directors, employees, contractors, affiliates, service providers, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

  • your use of the Site;
  • your violation of these Terms;
  • your violation of applicable law;
  • information you submit through the Site;
  • your violation of another person's rights;
  • your fraudulent, abusive, or improper conduct.

21. Governing Law

These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your place of residence require otherwise.

Because the Site is directed to U.S. consumers, certain U.S. federal and state laws may also apply to privacy, marketing, consumer protection, telecommunications, advertising, and related matters.

22. Dispute Resolution

Before filing any claim, you agree to first contact us at support@paydownway.com and give us a reasonable opportunity to resolve the issue informally.

Any dispute that cannot be resolved informally will be handled in the competent courts of Estonia, unless applicable law gives you a non-waivable right to bring a claim in another jurisdiction.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer-protection laws.

23. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last updated" date above. Changes become effective when posted unless a later effective date is stated.

Your continued use of the Site after updated Terms are posted means you accept the updated Terms.

24. Termination

We may suspend, restrict, or terminate your access to the Site at any time if we believe you violated these Terms, submitted improper information, created risk for us or others, or used the Site in a way that may be unlawful, abusive, or harmful.

You may stop using the Site at any time.

25. Severability

If any part of these Terms is found invalid, illegal, or unenforceable, the remaining parts will remain in effect.

The invalid, illegal, or unenforceable provision will be interpreted or replaced to achieve the original purpose as closely as legally permitted.

26. No Waiver

Our failure to enforce any part of these Terms is not a waiver of our right to enforce that or any other part later.

27. Entire Agreement

These Terms, together with the Privacy Policy and any other disclosures posted on the Site, form the entire agreement between you and Growefy Media OÜ regarding your use of the Site.
